We are an independent platform focused on the creation of high-performing marketing videos. People who sign up for Breakout Clips can create engaging videos for any purpose.

What Information Do We Collect?

The types of information that Breakout Clips may collect includes, but is not limited to, the following categories listed below. We may receive this information when it is provided directly to us by you (including through interaction with our Services), our business partners, and in some cases, certain trusted service providers we work with. We may also obtain information from other sources for example, we may collect information about you from publicly available sources such as social media platforms. We may combine information that we receive from the various sources described above for the purposes identified in this Privacy Policy.

Depending upon your use of our Services, we may collect some or all of the following data:

  • Account Information: Name, email address, username, password, billing information, and contact details
  • Usage Information: Information about how you use our Services, including videos created, features accessed, and interaction patterns
  • Device Information: Device type, operating system, browser type, IP address, and unique device identifiers
  • Payment Information: We use Stripe, a third-party payment processor trusted by companies like Amazon, Google, and OpenAI, to process payments. We do not store your full credit card details on our servers. Stripe collects and processes your payment information directly.   • Communications: Messages, feedback, and support requests you send to us
  • AI Generation Data: Text prompts and instructions you provide for AI content generation, images and files you upload for AI processing, AI-generated assets (images, videos, animations) you create, settings and preferences for AI generation, and usage patterns related to AI features (number of generations, types of content created)

We may also collect, use and share aggregate and deidentified information that does not identify you as permitted by applicable laws. For example, we may collect, analyze and share statistical information about number of visitors to Breakout Clips's website in order to better understand and improve our Services.

Information Collected Automatically

As is true of most websites and applications, Breakout Clips may collect certain information automatically through your interaction with our Services using technologies such as, cookies, pixels, web beacons and tags. We track and store data about how you visit and use Breakout Clips Services, particularly through our websites and apps. Interest Based Advertising

The third-party advertisers, ad agencies and other vendors with which we work may be members of the Network Advertising Initiative, the Digital Advertising Alliance Self-Regulatory Program for Online Behavioral Advertising and/or the European Digital Advertising Alliance. To opt out of interest-based advertising from the participating companies, please visit AboutAds.info or the European Digital Advertising Alliance for laptops and NAI Mobile Choices or AppChoices for mobile devices. Note that opting out through these channels does not mean you will no longer see ads and is specific to the device and browser you are using.

Do-Not-Track Signals

Your browser or device may include "Do-Not-Track" settings or functionality. Currently, our systems do not recognize browser "Do-Not-Track" requests. The information collection and disclosure practices, and the choices that we provide to customers, will continue to operate as described in this Privacy Policy, whether or not a Do-Not-Track signal is received. How We Use the Information

We use information to provide the best possible Services to you. These uses may include:

  • AI Model Training and Improvement: For all users (Free Plan, Starter Plan, Pro Plan, and Ultra Plan), we may use your AI prompts, uploaded content, and generated assets to train, improve, and develop our AI models and systems to enhance service quality for all users
  • Public Showcase and Marketing: For Free Plan and Starter Plan users, we may publicly display, showcase, and use your generated content for marketing, promotional, and demonstration purposes. For Pro and Ultra Plan users, your content may be used for public showcase and marketing unless you opt out during the video generation process

Communications with you in connection with these uses may be via mail, telephone, e-mail, text message, social media and other electronic messages. If legally permitted in your jurisdiction, we may send you text messages using an automated telephone dialing system to the mobile phone number you have provided if you have opted into receive text messages. Opting into receive text messages is not a requirement to buy services from Breakout Clips, and message and data rates may apply. See "Your Choices" below to learn how to manage your communication preferences.


Data Retention

We retain your personal information as long as we have an ongoing legitimate business need to do so, such as to provide services or products to you, or as required or permitted by applicable laws, such as tax and accounting laws. When we have no ongoing legitimate business need to process your personal information, we may either delete, deidentify or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from further processing until deletion is possible.

AI Generated Content:
  • We retain AI-generated content, prompts, and uploaded materials in accordance with our legitimate business needs and legal obligations
  • Free Plan content may be retained indefinitely as it is owned by the Company and may be used for AI training and showcase purposes
  • The retention period for other content may vary based on your subscription status, usage patterns, and our operational requirements
  • Upon account deletion, we will delete or anonymize your personal information in accordance with our data retention policies and legal obligations, except where we have ongoing rights to use the content (such as Free Plan content)

Security

We use reasonable physical, technical, and administrative safeguards to protect personal information within our organization. We want you to feel confident using our Services, however no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account with us has been compromised), please immediately contact us in accordance with the "Contact Information" section below.

You are responsible for maintaining the confidentiality of your Services access information and password and for restricting access to your device, and you agree to accept responsibility for all activities that occur under your password.


Who Do We Share Your Information With?

We may share the information we collect about you in the following circumstances:

  • Service Providers: We may share your information with third-party service providers who perform services on our behalf, including AI processing, content generation, payment processing (including Stripe for payment transactions), data analysis, email delivery, hosting services, customer service, and marketing assistance. These providers are contractually obligated to protect your data and use it only for providing services to us
  • Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business
  • Legal Requirements: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency)
  • Protection of Rights: We may disclose your information when we believe disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request
  • With Your Consent: We may share your information with third parties when you give us consent to do so
  • Aggregate Information: We may share aggregated or deidentified information that cannot reasonably be used to identify you

Third-Party Platform Usage

When you post or distribute videos and AI assets created through our Services to third-party platforms (such as social media or advertising networks), those platforms will collect and process data according to their own privacy policies. We are not responsible for how third-party platforms handle your content or data. Please review the privacy policies of any platforms where you post our content.


Links to Other Sites

We are not responsible for the practices employed by any applications, websites or services linked to or from our Service, including the information or content contained within them. Please remember that when you use a link to go from our Service to another application, website or service, our Privacy Policy does not apply to those third-party applications, websites or services. Your browsing and interaction on any third-party application, website or service, including those that have a link on our Services, are subject to that third party's own rules and policies.


Your Privacy Rights

  • California Privacy Rights (CCPA)

    California residents have a right to knowledge, access, and deletion of their personal information under the California Consumer Privacy Act (CCPA). California residents also have a right to opt out of the sale of their personal information by a business, however Breakout Clips does not sell personal information.

    When we say "Personal Information" in this disclosure, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. Personal Information does not include information that is aggregated or information that cannot be reasonably linked to you.

    Breakout Clips provides notice of our data practices throughout this Privacy Policy. This includes the categories of personal information we may collect (including account information, usage information, device information, payment information, communications, and AI generation data such as text prompts, uploaded images, generation preferences, and AI-created content), the categories of sources of personal information, the purposes of use (including AI model training and improvement, and public showcase and marketing for applicable plan types), as well as the categories of parties with whom Breakout Clips may share personal information in the past 12 months.

    Right to Know

    This section describes the CCPA rights that you may have and explains how to exercise those rights. You have a right not to receive discriminatory treatment for exercising these privacy rights and Breakout Clips does not discriminate in response to privacy rights requests.

    You have the right to request up to twice in a 12-month period that we disclose certain information to you about our collection, use and disclosure of your Personal Information over the past 12 months. Once we receive your request, verify your identity and determine that we have your information, we will disclose to you the information you request in the following areas: (1) the categories of Personal Information we collected about you; (2) the categories of sources for the Personal Information; (3) our business or commercial purpose for collecting that Personal Information; (4) the categories of third parties with whom we shared that Personal Information; and (5) the specific pieces of Personal Information we collected about you in the preceding 12 months.

    Right to Delete

    You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive your request, verify your identity and determine that we have your information, we will delete your Personal Information from our records, unless an exception under the CCPA applies. In our response to your request to delete, we will specify the manner in which we have deleted your Personal Information or, if we must deny your deletion request, the basis for this refusal.

    You may designate an authorized agent to submit your consumer request on your behalf, so long as the authorized agent has your written permission to do so and you have taken steps to verify your identity directly with us.

    We cannot respond to your request to know or request to delete if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify your identity or authority to make the request. To verify your identity, we may ask you to provide us with the following information when you submit your request: (1) first name, (2) last name, and (3) phone number or email. We will use the above information to verify your identity. We will require additional information to verify your identity and fulfill your request depending on the type of request or the information requested by you.

    Please note that the privacy choices described above apply specifically to Breakout Clips and the personal information that Breakout Clips collects about you. We do not control the privacy practices of other companies, therefore if you would like for your privacy choices to apply to other companies or to the personal information that we may hold as their service provider, then you will need to reach out directly to the other companies and submit your requests.

    California Shine the Light Law

    Pursuant to California Civil Code Section 1798.83, we do not disclose information of consumers from whom we directly collect data to third parties for the third parties' direct marketing purposes.

  • European Privacy Rights (GDPR)

    Automated Decision-Making

    Our AI generation services use automated systems to create content based on your inputs. This processing does not involve profiling or decisions that produce legal or similarly significant effects on you. You control what content is generated and how it is used.

    Your right described in this section does not apply in the following circumstances:

    • The decision is necessary for the entry into, or performance of, a contract between you and us
    • The decision is authorized by law and there are suitable safeguard for your rights and freedoms
    • You have given your explicit consent

    Profiling

    Where We use your personal data for profiling purposes, the following shall apply:

    • Clear information explaining the profiling will be provided, including its significance and consequences
    • Appropriate mathematical or statistical procedures will be used
    • Technical and organizational measures necessary to minimize the risk of errors and to enable such errors to be easily corrected shall be implemented
    • All personal data processed for profiling purposes shall be secured in order to prevent discriminatory effects arising out of profiling

    Data Transfers

    Breakout Clips may need to transfer your personal data outside of your home country in order to provide our Services. You authorize us to transfer, store, use and process your data in the United States, Ireland, and any other country outside of your home country. Marketing Communications

Public Showcase Opt-Out (Pro/Ultra Plans Only)

Pro and Ultra Plan users may opt out of having their AI-generated content used for public showcase and marketing purposes during the video generation process. Please note that opting out of public showcase does not opt you out of AI model training, as all user data may be used to improve our AI models and services.

Children's Privacy

Our Services are not intended for children under 13 years of age, or the equivalent age as specified by law in your jurisdiction, and we do not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.
